The Owner and the Operator must maintain these records for a period of three years in addition to the period specified for Category A, Category B and Category C operators. The examination or training record must also be signed by the examiner or trainer at least, and list the printed name of the examiner or trainer and the name, address and telephone number of the employer of the examiner or trainer. The test records of Class A or Class B operators must include the areas tested by Class A or Class B operators. 598.13 Prohibited Delivery. (a) Conditions and procedures for implementing the delivery ban. (1) Level 1 conditions. (i) When the department finds a Level 1 condition in the facility, the department will label the filler pipe of the relevant tank system. (ii) When labeling, if the facility operator is present, the department will provide him with a written notice of the implementation of the delivery ban, including the conditions related to the discovery of the facility. The department will then send a written notice by registered mail to the mailing address listed in the current facility registration or permit within five working days after the label is attached to the tank system. (iii) The following are Level 1 conditions: 1 NYCRR Part 598 – 11 October 2015 Page 26, where the tank system is known to be releasing hazardous substances. If the source of the release cannot be determined after inspection, all tank systems in the facility that may be the source of the release shall be marked.
(b) The underground storage tank system does not have one or more of the following: (1) secondary containment equipment required by Sections 599.4 and 599.14 of this chapter; (2) Spill and spill prevention equipment required by section 599.17 of this title; (3) Corrosion protection equipment required by 599.3 (d) or 599.13 (b) of this title; Or (4) leak detection equipment required by 599.5 or 599.15 of this title. (2) Level 2 conditions. (i) When the department finds that the facility has secondary conditions, the department can label the filler pipe of the relevant tank system. (ii) Before labeling, the department will send a written statement to the facility informing it of the situation. The Ministry will send the statement by registered mail to the mailing address listed in the current facility registration. (iii) When labeling, if the facility operator is present, the department will provide him with a written notice of the implementation of the delivery ban, including the conditions related to the discovery of the facility. The department will then send a written notice by registered mail to the mailing address listed in the current facility registration or permit within five working days after the label is attached to the tank system. (iv) The following are Level II conditions:.
