Respond immediately; (ii) Physical surveys, which may include sampling of soil, air or water to determine on-site and off-site impacts, hydrogeological and atmospheric surveys, pollution mapping, and assessment of potential impacts on plant life, wildlife, nearby water supplies, and surrounding populations; (iii) Monitoring the gap area between the storage tank and the secondary system; (iv) Check to determine if the tank system is tight. This may include internal inspection, structural integrity testing, non-destructive testing, inspection/testing of auxiliary equipment or leak tightness testing of tanks or pipelines; (v) Check inventory records to find discrepancies; (vi) Monitoring observation wells; Or (vii) any other additional and further investigations that may be required by the Department to fully determine the cause of the spill and to assess the impact of the spill or the spill on public health, safety and the environment. (2) The results of the survey must be submitted to the department within 14 days unless the department has developed an alternative plan. After reviewing this information, the department may request to collect, evaluate and submit additional information and prepare a response and corrective action plan. (3) If any hazardous substance occurs, is suspected or may be released, the Department may order the owner to inspect any tank system, location and/or related equipment that may be the actual, suspected or possible source of release, and to test for tightness and structural stability. If the Owner fails to carry out such test within 10 days after receiving the notice of such order, the Department may carry out such test. The reasonable costs incurred by the Department in carrying out such tests shall be paid by the Employer. (e) Corrective measures.
(1) After completing the investigation of the actual, possible or suspected leak, the owner or operator must take corrective action and take other spill response actions as may be required by the department. This may include one or more of the following: (i) removal and proper disposal of contaminated soil; 6 NYCRR Part 598 – October 11, 2015 Page 33 of 35 598.14 (e) (ii) Removal and recovery of free floating and dissolved harmful substances in groundwater and surface water; (iii) removal, discharge, dispersion or recovery of steam from soil or air; (iv) Repair or replace leaking equipment; (v) Improving storage and handling practices; (vi) Improvement of secondary containment system; (vii) installation of temporary or permanent water supply systems; (viii) Relocation of residents; (ix) Develop a corrective action plan; And (x) such other actions as may be required by the Department to remedy the Site to protect public health, safety or the environment. (2) The owner or operator must report the progress of implementing the response and corrective action plan to the department according to the report schedule established by the department. (3) The requirements of this subsection do not apply to the discharge of underground storage tank systems: (i) solid waste management units that are identified as facilities requiring corrective action in accordance with Article 27, Part 9 of ECL; Or (ii) constitute hazardous waste at the site affected by the remediation plan in accordance with Article 27, Part 13 of the ECL.
